* Safe storage of firearms and safety devices are available at any place in which firearms are sold under the license to persons who are not licensees ( “Stockpiling of security or safety” defined in 18 USC 921 (a) (34)

Information on the Class 3 License

The Class 3 License appertains to a small arms dealer who’s paid a tax named the “Special Occupational Tax” to conduct business with machine guns and various other “National Firearms Act weapons” or NFA for short.  This is the type of FFL License that most enthusiasts go after. I can’t blame them either, the class 3 license allows it’s holders to do all of the fun stuff, mainly buying and selling fully auto weapons.

Machine guns, Noise suppressors, Snub Barrel Rifles, Shotguns, or Any Other Weapons  are checked and assessed under the  control of the national Firearms Act circa 1934 ( NFA ) as altered by Title II of the Gun Control Act ( GCA ) in 1968.

If you want to deal in NFA firearms, silencers or explosives you will need to get yourself a class 3 license.

Class 3 License- The Many Types Of FFL’s

Semi-automatic and other firearms excluding big-bore or destructive explosive devices are controlled by Title one in the Gun Control Act ( GCA ). What many people accidentally call Class 3 License is correctly known as NFA or Title two firearms. Figuring out what type off ffl you need can be a task in itself. There are many different types of ffl licenses as you can see below.

• A Class 3 License SOT dealer refers to a dealer of NFA fire-arms
• A Class two SOT manufacturer refers to a manufacturer of NFA fire-arms
• A Class one SOT importer refers to an importer of NFA fire-arms
• Type one FFL pertains to a Title one gunsmith or dealer
• Type two FFL pertains to a Title one dealer conducting business as a pawnbroker
• Type three FFL pertains to an approved collector of Curio & Relic ( CR ) firearms
• Type six FFL pertains to an approved maker of ammo and reloading parts apart from Armor Piercing ammo
• Type seven FFL pertains to a Title one manufacturer of firearms, ammo and ammo elements apart from NFA, Destructive Devices and Armor Piercing ammo Type eight FFL pertains to an importer of Title one firearms and ammo
• Type nine FFL pertains to an FFL dealer in Title one fire-arms to include NFA destructive devices, but not to include other NFA
• Type ten FFL pertains to a maker of Title one firearms, ammo and ammo elements, to include NFA Destructive Devices and no other NFA, and excluding Armor Piercing ammo
• Type eleven FFL pertains to an importer of Title one firearms, ammo and NFA Destructive Devices, but no other NFA

To obtain a Class 3 License SOT standing, you will want a dealer or manufacturer FFL that includes Type one, two, seven, eight, nine, ten or eleven.

Do You Need An FFL Kit To Get A Class 3 License?

While you don’t “need” an FFL Kit to get your class 3 license it’s definitely a good idea. I often visit gun forums and hear that you don’t need a kit for the class 3. I would agree with them if this were 7 years ago, times have changed.

Years ago it was easier to get your class 3 license but these days the ATF makes it tricky to keep the numbers of class 3 holders as low as possible.  Once you get denied you get blacklisted and won’t get approved ever you also do not get your application fee back.

FFL Requirements

The Gun Control Act (18 U.S.C. sec. 923(d)) grants the Bureau of Alcohol, Tobacco and Firearms the power to regulate businesses involved in firearms sales and service and sets out the federal firearms license requirements.  Possessing an FFL to engage in such activities has been required in the USA since the passing of the Gun Control Act in 1968.

Before you get started on the road to getting your FFL lets make sure you meet the minimum FFL requirements listed below. It costs $200 to apply for your FFL (includes first 3 years fee) and if you get denied you don’t get it back.

FFL Requirements

Ok then here they are:

• 21 years or more of age;
• Not prohibited from shipping, transporting, receiving or possessing firearms or ammunition;
• Not willfully violated the GCA (Gun Control Act) or its regulations;
• Not willfully failed to disclose material information or willfully made false statements concerning material facts in connection with his application;
• Has a place (which in many cases can be your home or even an apartment) for conducting business or collecting for C&R; and the applicant certifies that:
  1. The business to be conducted under the license is not prohibited by State or local law in the place where the licensed premise is located;
  2. Within 30 days after the application is approved the business will comply with the requirements of State and local law applicable to the conduct of the business;
  3. The business will not be conducted under the license until the ffl requirements of State and local law applicable to the business have been met; and,
  4. The applicant has sent or delivered a form to the chief law enforcement officer where the premises are located notifying the officer that the applicant intends to apply and meets the federal firearms license requirements.
  5. Secure gun storage or safety devices will be available at any place in which firearms are sold under the license to persons who are not licensees.

FFL Requirements -After You Get Approved

FFL holders must also keep a registry of their firearms sales in an ATF approved Bound Book, or by using ATF approved software. They also need to keep file copies of “Firearms Transaction Record” documents, for a time period of not less than 20 years after the date of sale or disposition. When retiring or otherwise giving up a license, these records are sent to the BATFE’s Out-of-Business Records Center. The ATF is allowed to inspect, as well as request a copy of these forms from the dealer during the course of any criminal investigation. Additionally, the sale of two or more handguns to a person in a five business days must be reported to ATF.

FFL Requirements Are Strict So Get Help!

If you meet the above criteria, you are a good candidate for getting your FFL License. That may seem pretty complicated to many of you and for good reason. It’s complicated by design, it’s just another way for the government to chip away at our gun rights!

C&R License a quick primer

The Federal Firearms License 03 (FFL03)/ C&R License allows you to become a licensed collector of Curio & Relic (C&R License) firearms. This includes pretty much any firearm older than 50 years as well as certain special configuration and certain “oddity” weapons. The old saying, “they just don’t make em like they used to” applies here.

The FFL03/C&R License is useful for anyone who is interested in purchasing surplus / military surplus rifles and/or pistols. The fee for the C&R is $30 for three years. Your benefit is that it allows you to purchase this type of weapon without doing an FFL transfer, which in my area costs between $10 and $25 dollars, depending who you purchase from.

The C&R enables you to acquire approved firearms and weapons through state lines, transfer said weapons amongst licensed individuals, and order these weapons through mail (FedEx or UPS).

Can you sell weapons with a C&R License

This area is a little tricky. Yes, you may sell your C&R acquired firearms, however you can’t do it as your “livelihood”. You can also “dispose” of or sell C&R weapons to individuals whom are not prohibited within your state and also to a licensee residing  in another state.

What’s a C&R weapon

Curios or Relics-> Firearms interesting to collectors for reason other than normally associated with weapons intended for use in sporting or use as defensive or offensive weapons. Firearms classified as curios or relics, must fall into a category below:

• Firearms made a minimum of 50 years before today’s date, not to include replicas thereof;
• Firearms certified by a curator of municipal, State or a Federal museum that displays firearms as curios or relics possessing  museum interest; and
• Additional firearms that derive a great portion of their value from being novel, bizarre, rare, or due to their association an event, historical figure or period.

You need to keep a record of all of your transactions, but that’s not a big deal.

Following their directions, you should receive your C&R License withing a month or two. The only hard part (once you get help to fill out all of the paperwork) about getting the license is finding your CLEO (Chief Law Enforcement Officer) information, which is fairly trivial; either Google for your area’s Police Department (for me it was Fairfax County Police Department) or possibly call your county or city non-emergency number.

If you call, ask for the name and business address of the Chief of Police for the purpose of obtaining an ATF Federal Firearms License. When you want to start making purchases from one of the approved gun dealers you will need to send a signed copy of your FFL to the dealer.

The Time To Become A Gun Dealer Is NOW

Fifteen years ago there were 23 federal firearms licenses issued in Belchertown. Today, there are three. “I would say is a severe drop,” said Rich Kimball, R & R sale of arms, 450 State St., and one of three remaining licensees.

Stricter regulations of federal licensing dating back to 1993, plus the general climate of Massachusetts, with some of the toughest laws for firearms in the country, have made it difficult for gun dealers in the State of Bahia, According to Kimball. The combination, he says, “has caused many dealers to leave the state.”

Since 1994, the number of federal licensing of firearms – FFL – issued in Massachusetts has decreased from 4109 to 531, or by 87 percent. A federally licensed firearms permit is necessary for any business that makes, repairs, sells, imports or engages in the display of firearms or ammunition.

A federal license is also required for companies that make or importing of “destructive devices”, specialized heavy weapons such as bean sprouts firearms or weapons bag, which can be fitted to fire explosives illegally.

The total number of federal licensing of firearms in Franklin, Hampden and Hampshire counties, fell by 76 percent, 446 to 120. Eighty-six of the 120 licenses are licenses of type 1, required for arms dealers. There are 26 Type 7 licenses are issued to dealers, four Type 8 licenses for importers of arms and three Type 6 licenses to manufacturers of ammunition.

There are two type 10 licenses issued to manufacturers of destructive devices or ammunition for destructive devices. Kollmorgen, Northampton company that works for the Department of Defense, holds one, and ZM Weapons, a high performance manufacturer of weapons in Bernardston, holds the other.

Among individual communities across the three counties, the decline in total numbers of federal licensing of firearms is drastic. Springfield used to have 72 total licensees, there are now 10. Three of them are in the hands of gun manufacturer Smith & Wesson, and one by the Springfield Library and Museums Association, who needs to show his collection of weapons.

Westfield went from 44 to nine, Chicopee, from 38 to seven, and Greenfield, who once had 20 FFL holders, which now has one. In 1993 there were 240,000 federally licensed firearms issued nationwide.

As noted in time by a pro-gun control, there were more licensed dealers of firearms in the United States than there were gas stations. Since then the number has dropped to about 109,000, or 62 percent, according to the Bureau of Alcohol, Tonacco, Firearms and Explosives.

The decrease is part of a national trend that goes back two pieces of legislation, according to the federal agency that oversees licensing. The first is the Brady bill, named for the White House, James Brady, who was shot in an assassination attempt on President Ronald Reagan in 1981.

It increased the license fee of $ 10 per year to $ 200 for the first three years and $ 90 for each renewal for three years. The second piece of legislation was the control of violent crime and Law Enforcement Act of 1994, also known as the Criminal Law. It requires applicants for federal licenses to notify your local law enforcement department and submit fingerprints with a photo to go with the application and certify that their companies adhere to local zoning regulations. It also requires gun dealers to have a place established for its stores to be separated from their residences.

This eliminates many amateur and part-time traders. At that time, the Clinton administration was worried about the smaller arms dealers operating under the radar and possibly outside the law. Police departments complained that the dealer licenses easy to obtain and difficult to follow, are often the last to know to whom licenses were issued. Kimball said that with the highest rates and the demand front of the store, many smaller retailers has just decided that it no longer worthwhile. “It used to be you could get a license for your garage, basement or bedroom,” he said.

“It took over most of the dealers”. Nine of the 12 licenses granted in Agawam are held by four companies, Walter A. Meissner, Jr., Sports Car Distributors, Ltd Cortzar, Three-Ten Corp. and Taugwank Spur Corp, which all operate from one location: 396 Main St. Three-10 Corp is a small arms development and research  busines that is chaired by Alma E. Marcinkiewicz, of Agawam. The Taugawank Spur Corp. is an arms sale and real estate business owned by Ronald L. Gaudette, also of Agawam. Cortazar LTD. is a small arms importer, manufacturer and distributor.

It is owned by James L. Hansmann. Gaudette said the four share a location to comply with the law that requires a store. None of them is a major distributor, and sharing a place is cheaper than each store individually, he said. Meissner said that once you stop for small traders, but now feels that the government has overstepped its bounds.

“It has gone too far – too far,” he said. James L. Wallace, executive director of the Northboro-based Gun Owners Action League (GOAL), agrees, saying the legislation did nothing to force a lot of law-abiding merchants out of business. “The state decided to firearms retailers should not have the same rights to run a small business like any other business owner,” he said.

Most small businesses were in rural parts of the state. Residents of troops out of those areas to travel further to find licensed distributors said. In short, federal law and state regulations did little to fight crime, says Wallace, but have failed to put a lot of honest traders of the company. He also cited the gun control Act of 1998 Massachusetts, which he said passed more layers of restrictions and regulations for the purchase and sale of firearms.

West Springfield Police Chief Thomas E. Burke said the new rules were a good thing for the police, though dealers can not agree. “It is difficult at mom and pop retailers who would sell weapons,” he said. West Springfield rose from 16 federal firearms license holders in 1993 to five today. Burke said that before the regulation, the police were hard to keep track of distributors. “There was a lot of things that were not aware of,” he said. “It’s good for us to know exactly where are the dealers,” he said.

His department conducts audits of distributors once a year and sometimes makes surprise inspection to ensure that the registration books are in order, he said. Police may impose conditions for storage, such as safes in arms and, in some cases, burglar alarms, according to Burke. A major concern for police is that the weapons stolen in the robbery will go to the hands of criminals on the street, he said. Kimball, an arms dealer for 25 years, said that in the last decade the amount of paperwork and forms to fill out every time it receives an order for guns or sell one has increased dramatically.

Like all dealers, which is required to keep detailed records of all weapons into or out of his tent. The register must be available for inspection by authorities at any moment, and woe to any dealer whose registration does not match the inventory. “We can not make mistakes and jeopardize the business,” he said. “We would be in trouble. Not sold more.”
